Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Panic Gift mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Panic Gift is an iOS mobile application that allows users to create AI-generated gift announcement cards. The App uses Google's Gemini AI API to generate custom card images based on user-provided text and preferences.

Service Features:

• AI-powered custom gift card generation
• Multiple style options and occasions
• High-resolution (4K) image output
• Credit-based usage system
• In-app purchases for additional credits

3. User Accounts and Credits

Free Preview

New users receive one (1) free AI preview generation upon first use of the App. This allows you to see the AI-generated card styles before purchasing. The free preview does not include a final high-resolution card. This free preview cannot be transferred, refunded, or exchanged for cash value.

Purchased Credits

Credits may be purchased through the App Store as consumable in-app purchases. Current packages include:

• Single Card: 1 credit
• Starter Pack: 2 credits
• Value Pack: 5 credits

Credits are:

• Non-refundable once used for card generation
• Non-transferable between users or devices
• Valid indefinitely with no expiration date
• Stored securely on your device

Credit Usage

One (1) credit is consumed when you complete a card generation (preview and final card). Each credit includes one (1) preview generation and one (1) final high-resolution card. If you cancel the generation process before completing the final card, your credit may be refunded at our discretion.

4. User Content and Conduct

Your Responsibilities

You are solely responsible for the content you create using the App. You agree not to use the App to create content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or offensive
• Infringes on intellectual property rights of others
• Contains personal or sensitive information of others without consent
• Violates any applicable laws or regulations
• Attempts to circumvent or abuse the credit system

Content Ownership

You retain ownership of the text content you input into the App. Generated images are provided to you for personal, non-commercial use. You may share, print, or distribute cards you create for personal gift-giving purposes.

5. AI-Generated Content

AI Technology Disclosure

All card images in Panic Gift are created using artificial intelligence (AI) technology. Specifically, we use Google's Gemini AI API to generate unique images based on your input. Each card is uniquely generated at the time of creation—cards are not selected from a pre-made library.

By using the App, you acknowledge and agree that:

• Your text input (gift details, names, messages) is sent to Google's AI service for processing
• AI-generated content may occasionally contain imperfections or unexpected results
• Generated images are created algorithmically and results may vary

No Guarantees

While we strive to provide high-quality AI-generated images, we make no guarantees about:

• The exact appearance or quality of generated images
• Text rendering accuracy or placement
• Generation speed or availability
• Similarity between style previews and final output
• The ability of the AI to accurately represent specific products or items

Regeneration

If you are unsatisfied with a generated card, you may regenerate using an additional credit. Credits are non-refundable even if you are dissatisfied with the output.

6. Purchases and Payments

In-App Purchases

All purchases are processed through the Apple App Store and are subject to Apple's Terms and Conditions. Payment will be charged to your Apple ID account at confirmation of purchase.

Refund Policy

All sales are final. We do not offer refunds for purchased credits. If you believe you were charged in error, please contact Apple Support for assistance with App Store purchases.

Price Changes

We reserve the right to modify credit pricing at any time. Price changes will not affect credits you have already purchased.

7. Intellectual Property

Our Rights

The App, including its code, design, features, and branding, is owned by Panic Gift and protected by copyright, trademark, and other intellectual property laws.

Third-Party Services

The App uses Google's Gemini AI API for image generation. Your use of this service is also subject to Google's terms and policies.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The App will be uninterrupted, secure, or error-free
• Generated images will meet your expectations
• Any errors or defects will be corrected
• The App will be compatible with future iOS versions

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

10. Modifications to the Service

We reserve the right to:

• Modify or discontinue the App at any time
• Change features, functionality, or pricing
• Update these Terms at any time

Continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the App at any time, with or without cause or notice, including if you violate these Terms. Upon termination, unused credits will be forfeited.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Age Requirements

The App is not intended for use by individuals under the age of 13. By using the App, you represent that you are at least 13 years old.

14. Apple App Store

This App is available through the Apple App Store. You acknowledge and agree that:

• These Terms are between you and Panic Gift, not Apple
• Apple has no obligation to provide support or maintenance
• Apple is not responsible for the App or its content
• Apple is a third-party beneficiary of these Terms

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Panic Gift regarding the App.
